Who is responsible for compliance with the regulations?
Basically speaking, the owner or the managing director of the company involved in transporting dangerous goods is responsible for compliance with the regulations. The owner/managing director must guarantee adherence to the dangerous goods regulations. The owner/managing director can delegate responsibility as a binding agreement to individual employees for a sub-area by specifying the activities being transferred and allocating them to the employee. This agreement should always be in writing. An exception is the driver. In this case, the legislative text delegates clear duties to vehicle drivers which they must observe at all times.
The duties specified by the legislation should only be performed by persons who have received adequate training for their respective area of work. Everyone involved in the handling of dangerous goods must have received appropriate instruction in accordance with regulations before beginning work. Training courses can be run by in-house members of staff or by external trainers. This is the responsibility of the employer/managing director.
